Complying Development Certificates
What is Complying Development?
Complying development is a combined planning and construction approval for straightforward development that can be determined through a fast track assessment by a council or private accredited certifier. Complying development applies to homes, businesses and industry and allows for a range of things like the construction of a new dwelling house, alterations and additions to a house, new industrial buildings, demolition of a building and changes to a business use.
Complying development generally includes larger building works than exempt development. For this reason ‘sign off’ by a building professional (known as a certifying authority) is needed. Complying development is also subject to conditions of approval to protect surrounding uses during the construction period and the life of the complying development.
Applications must meet a set or requirements to be able to be assessed as Complying Development under the State Environemtal Planning Policy (Exempt and Complying Development) Codes 2008, Warrumbungle Shire Council is under the 4D Inland Code.
Not all developments can be undertaken through Complying Development if the development does not meet the criteria a Development Application/Construction Certificate will need to be lodged.

Below are the steps that need to be followed to lodge a Complying Development Certificate with Council.
Step 1 - Lodging an Application
Applications for Complying Development Certificate must be applied for on the NSW Planning Portal and include the following information:
- Site Plan showing the location of the development and all other structures including:
- Show distances to other structures and fences
- North Point
- Any Bush Fire Protection requirements
- Stormwater connection to Kerb and Gutter (in town only)
- Engineered Plans for:
- Slab or footing details
- Frame design and layout
- Truss details
- Specification Sheet for the development.
Applicants must also complete a PCA Appointment Application on the Portal to appoint Council as the Principal Certifier.
Step 2 - Pre-lodgment Review
Once all documentation is uploaded Council Staff will review the documents and send notification if more information is needed. If the information is sufficient then a Fee Quote will be sent for payment of fees. No assessment is undertaken until fees are paid.
Step 3 - Approval of Application
The Complying Development Certificate once approved will be uploaded to the NSW Planning Portal and construction can commence.
There will be a number of Conditions that need to be met while undertaking building works.
All conditions of consent must be met prior to requesting an Occupation Certificate.
Step 4 - Inspections
During the building process there are a number of mandatory Critical Stage Inspections that must be undertaken by Council Staff to progress through the build. All inspections must be booked in with Council at least 48hrs in advance to ensure that Staff are available to attend.
If an inspection is not booked in and work progresses Council Staff may not be able to issue an Occupation Certificate, and the building will not be able to be habited.
Step 5 - Ready for Occupation Certificate?
Once all building works are completed ensure that all Conditions of Consent have been completed prior to applying for an Occupation Certificate on the NSW Planning Portal.
Things to look out for:
- All Bush Fire Protection measures have been completed
- Smoke Detectors connected
- Water and Power is connected
- Driveway Access upgrade completed
- Certificates obtained:
- Smoke Detector Certificate
- Electrical Compliance Certificate
- Dark Skies Compliance Certificate
- Wet area Inspection Certificate including material data sheet and method of installation
- Glazing Certificate (In accordance of BAL requirements if applicable)
- Shower screen Certificate
- Termite Shield – Certificate in Electrical Meter Box
- Drainage diagram
- Gas Installation Compliance Certificate
